Requirements Prior to a Capacity Assessment

A consult by video or phone must be completed with the capacity assessment applicant to determine a formal capacity assessment is appropriate. A capacity assessor is legally required to obtain health records to confirm a medical assessment of the client has been completed by a physician within the three month period immediately preceding the capacity assessment. This is to ensure the adult being assessed is not was suffering from a reversible temporary medical condition that would be  likely to have a significant impact on the adult's capacity to make a decision about a personal matter or a financial matter. As well health records are required to confirm medical conditions and health history that would be pertinent to a capacity assessment.

Without a medical assessment or check up being completed in the past three months on the client, a capacity assessment can not legally  be completed. If you don’t have access to a family physician a walk in clinic physician or hospital assessment would be sufficient as long as the capacity assessor can obtain the required health records. As well you can call 8-1-1 Health link or go online to https://albertafindadoctor.ca/  or https://www.albertahealthservices.ca/info/Page13253.aspx to find family physicians accepting new patients.
